The rules for using KYSTA

Terms and conditions

These terms apply when you create a KYSTA profile or use the KYSTA application. They explain what KYSTA provides, what we ask from you, and where the service's limits are.

Short version

  • KYSTA is a personal tracking tool, not professional advice.
  • You control what you record and remain responsible for it.
  • Do not misuse the service, interfere with it, or use it to harm another person.
  • You can export your linked data and clear your tracking profile from Settings.
  • Consumer rights that cannot legally be excluded continue to apply.

1. Service provider and contact

KYSTA, Dorpsweg 46A, 1697 KB Schellinkhout, the Netherlands, provides the KYSTA application and the public website at www.kysta.app. KYSTA is registered with the Dutch Chamber of Commerce under number 89960017 and has VAT identification number NL865165518B01.

2. Accepting these terms

By actively accepting these terms in the application, you enter into an agreement with KYSTA for use of the service. The version and time of your acceptance are recorded. The separate Privacy Statement explains how personal data is processed.

You must be legally able to enter into this agreement. If you are under 18, you may use KYSTA only with permission from a parent or legal guardian. KYSTA is not directed at children below the digital-consent age that applies where they live.

3. What KYSTA provides

KYSTA lets you create and track goals, habits, activities, measurements and daily reflections. It can calculate progress, streaks, receipts and achievements, keep a device-scoped offline working copy, send optional reminders, and provide export and profile controls.

KYSTA may improve, replace or remove features as the product develops. Material reductions to a paid service will be handled consistently with applicable consumer law. Features described as planned, preview, beta or coming soon are not part of the current service commitment.

4. Personal tracking, not advice

KYSTA's calculations and messages are motivational information based on the data you enter. They are not medical, mental-health, financial, legal or other professional advice, and they are not a diagnosis or treatment.

Do not rely on KYSTA for emergencies or time-critical decisions. Contact the appropriate emergency service or a qualified professional when you need urgent help or professional care.

5. Your profile and access

  • Keep devices, email access, recovery codes and active sessions under your control.
  • Provide accurate information where accuracy is needed to supply or recover the service.
  • Notify KYSTA promptly if you believe someone has obtained unauthorised access.
  • An unclaimed device profile may be lost if its session expires or device data is removed. Linking an email address provides a recovery path.

6. Your content and licence

You keep ownership of content you enter into KYSTA. You give KYSTA a limited, non-exclusive licence to host, process, copy and transmit that content only as needed to operate, secure, support and improve the service in accordance with the Privacy Statement. This licence ends when the content is deleted, except for temporary backup retention and records KYSTA must keep by law.

You are responsible for choosing what to record and for having the right to enter it. Avoid recording another person's private or confidential information unless you have a lawful reason and their rights are respected.

7. Acceptable use

You must not:

  • use KYSTA for unlawful, fraudulent or abusive activity;
  • access or attempt to access another person's profile without permission;
  • probe, disrupt, overload, bypass or damage the service or its security controls;
  • introduce malicious code, automate abusive traffic, or extract data in a way that harms KYSTA or its users;
  • copy, resell or commercially exploit the service except where applicable law expressly permits it.

8. Plans, vouchers and payments

The Free plan has no purchase price. KYSTA Plus costs €2.99 per month or €24.99 per year. Consumer prices include 21% Dutch VAT. The available billing periods, total amount, included features and renewal terms are shown before checkout. Pro cannot be purchased while it is labelled coming soon. Voucher duration, expiry and plan limits shown when a voucher is issued or redeemed form part of the offer.

A Plus purchase is a recurring subscription. After the first payment, the selected amount is charged automatically each month or year until cancelled. You can stop future renewals in Settings. Cancellation does not remove Plus from a period that has already been paid; access continues until the displayed period end. A failed renewal may stop Plus after the paid period.

Mollie processes the payment method and recurring-payment mandate for KYSTA. KYSTA does not receive or store full bank or card details. An invoice is made available in Settings after KYSTA has verified a successful payment.

Where a statutory withdrawal right applies, a consumer may notify support@kysta.app within 14 days of entering the subscription. If you expressly request immediate performance during that period, applicable law may permit a proportionate charge for service already supplied. Mandatory refund, withdrawal and consumer rights are not limited by these terms.

9. Availability and data safety

KYSTA takes reasonable care to keep the service secure and available but does not promise uninterrupted or error-free operation. Maintenance, failures, network conditions, browsers, devices and third-party delivery systems can affect availability.

Offline data must reconnect before it can be confirmed by the backend. Use the export controls for a portable copy of your linked data. Do not treat a browser cache or an unclaimed device profile as your only backup.

10. KYSTA rights

The KYSTA name, visual identity, software, designs, documentation and other service materials are protected by intellectual property law. These terms give you a personal, limited, revocable, non-transferable right to use the service; they do not transfer ownership of KYSTA materials.

11. Suspension and ending use

You may stop using KYSTA at any time. Settings provides controls to export linked data and clear the tracking profile. Contact KYSTA if you need the underlying login identity deleted as well.

KYSTA may restrict or suspend access where reasonably necessary to address security, unlawful use, serious or repeated breach of these terms, or a legal obligation. Where appropriate, KYSTA will give notice and a reasonable opportunity to correct the issue.

12. Responsibility and liability

Nothing in these terms excludes or limits liability that cannot legally be excluded or limits mandatory consumer rights. Subject to that rule, KYSTA is responsible for loss that is a reasonably foreseeable result of failing to provide the service with reasonable care and skill.

KYSTA is not responsible for loss caused by information you enter, decisions you make from motivational calculations, unauthorised use you could reasonably have prevented, or circumstances outside KYSTA's reasonable control. KYSTA is supplied for personal use and is not responsible for business loss such as lost profit, revenue, opportunity or goodwill.

13. Governing law and disputes

These terms are governed by Dutch law. If you are a consumer, mandatory protections of the country where you normally live continue to apply. Please email support@kysta.app first so a complaint can be investigated. A dispute may be brought before the court that has jurisdiction under applicable consumer law.

14. Changes to these terms

KYSTA may update these terms when the service, law or risk profile changes. Material changes will be dated and presented for renewed acceptance before you continue using the application. Changes do not retroactively alter rights or obligations that have already arisen.
